This document is for use in conjunction with the General Conditions of Contract for Construction Works, Third Edition, 2015 and has been published by SAICE.

This document is for use in conjunction with the JBCC Principal Building Agreement, Edition 6.2 – May 2018. It is not intended for use with earlier editions of the JBCC Principal Building Agreement, or other principal contract agreements. This form of domestic subcontract agreement has a comprehensive set of legally compatible documents for use, such as Construction Guarantee, Payment Guarantee, Payment Advice Statement and Recovery Statement, and have been compiled in the interests of standardisation. They portray the consensus view of Master Builders South Africa of good practice and an equitable distribution of contractual risk. The documentation sets out a clear, balanced and enforceable set of procedures, rights and obligations which, when competently managed and administered, protect both the contractors and subcontractors.

This document, entitled the FIDIC Conditions of Subcontract for Plant and Design Build, has been prepared by the Federation lnternationale des lngenieurs-Conseils (FIDIC) for use in conjunction with the FIDIC Conditions of Contract for Plant and
Design Build, First Edition 1999. The clauses of general application contained in this FIDIC Conditions of Subcontract
for Plant and Design Build (referred to as the General Conditions of Subcontract) are based on the FIDIC Conditions of Subcontract for Construction, First Edition 2011 –
with changes where necessary to reflect the differences between the FIDIC Conditions of Contract for Plant and Design Build, First Edition 1999 and the FIDIC Conditions of Contract for Construction for Building and Engineering Works Designed by the Employer, First Edition 1999.

The Conditions of Subcontract for Construction have been prepared by the Federation Internationale des Ingenieurs-Conseils (FIDIC) for use in conjunction with the FlDIC Conditions of Contract for Construction for Building and Engineering Works Designed by the Employer, First Edition 1 999, and with the Multilateral Development Bank Harmonised Edition of the FIDIC Conditions of Contract for Construction for Building and Engineering Works Designed by the Employer, but only if the necessary amendments are made to reflect the significant differences between this harmonised edition and the FlDIC Conditions of Contract for Construction for Building and
Engineering Works Designed by the Employer, First Edition 1999. They replace the terms of the FIDIC Conditions of Subcontract for Works of Civil Engineering Construction, 1 st Edition 1 994, that were recommended for use in conjunction with the FIDIC Conditions of Contract for Works of Civil Engineering Construction (4th Edition 1 987, Reprinted 1 992 with Further Amendments).

This contract should be used for the appointment of a subcontractor for engineering and construction work where the contractor has been appointed under the NEC3 Engineering and Construction Contract
